According to David Miller, duties of domestic national and global justice are of equal importance, given that nationhood is both intrinsically valuable and not inherently an unjust way of excluding outsiders. The consequence of this?split?level? view is that it may be reasonable to prioritize domestic justice in some cases, while letting demands of global justice take precedence in others, depending on a weighting model which seeks to account for the relative urgency of domestic and global claims and the extent to (...) which agents are more closely attached to compatriots than to outsiders. In this chapter, I argue against this weighting model on grounds of internal coherence with the theory set out in National responsibility and global justice. I first inquire into the conditions under which justice at home conflicts with justice in the world at large, according to Miller?s main principle of global justice? respect for basic human rights. I then show that on Miller?s own understanding of the various duties of global and domestic justice, cases of conflict rarely arise, and that when they do, there is a powerful argument for prioritizing global duties on grounds of urgency, which contradicts the reasoning of the weighting model. Finally, I address a problem arising from Miller?s basic assumption that under?fulfillment of basic human rights in poor countries only generates claims of global justice to which rich nations are under a duty to respond, following the acceptance of a scheme of remedial responsibilities to provide aid by each of these nations. The normative structure of the split?level view set out in NRGJ needs to be clarified with respect to the key question of whether nations can be held to be under a duty of justice to bring such a scheme into existence in the first place. I en række afhandlinger beskrives den hollandske ISAF styrkes indsats i Afghanisatn fra 2001-2010. I en fireårig periode fra 2006-2010 var det hollandske kontingent indsat i den afghanske provins Uruzgan og opnåede bemærkelsesværdige resultater. Sikkerhedssituationen blev forbedret, den økonomiske udvikling blev stabiliseret ligesom den offentlige administration, uddannelsen af børn og sundhedsplejen m.v. blev forbedret. Efter 2010 er provinsen overtaget af amerikanske og australske tropper.

Research on social influences often distinguishes between social and quality incentives to ascribe meaning to the value that popularity conveys. This study examines the neural correlates of those incentives through which popularity influences preferences. This research reports an functional magnetic resonance imaging experiment and a behavioral task in which respondents evaluated popular products with three focus perspectives; unspecified focus, focus on social aspects, and focus on quality. The results show that value derived with a social focus reflects inferences of approval (...) and reward value, and positively affects preferences. Value derived with a quality focus reflects inferences of quality and negatively affects preferences. This study provides evidence of two distinct inferential routes on both a neurological level, represented by different regions in the brain, and a behavioral level. These results provide the first evidence that a single popularity cue can in different ways influence the value derived from product popularity. (shrink)

Since it was first proposed by Moses, Shoham, and Tennenholtz, the social laws paradigm has proved to be one of the most compelling approaches to the offline coordination of multiagent systems. In this paper, we make four key contributions to the theory and practice of social laws in multiagent systems. First, we show that the Alternating-time Temporal Logic (atl) of Alur, Henzinger, and Kupferman provides an elegant and powerful framework within which to express and understand social laws for multiagent systems. Second, we show that the effectiveness, feasibility, and synthesis problems for social laws may naturally be framed as atl model checking problems, and that as a consequence, existing atl model checkers may be applied to these problems. Third, we show that the complexity of the feasibility problem in our framework is no more complex in the general case than that of the corresponding problem in the Shoham–Tennenholtz framework (it is np-complete). Finally, we show how our basic framework can easily be extended to permit social laws in which constraints on the legality or otherwise of some action may be explicitly required. We illustrate the concepts and techniques developed by means of a running example. (shrink)

To many in the Netherlands it seems that basic income’s time has come, following the wide appeal of several municipal experiments. These random-control trial designs study the effects on employment, social participation, health and well-being of exempting social assistance claimants from the duties of seeking work and participating in training activities under the workfare-oriented Participation Act. In some treatment groups, claimants also retain a larger percentage of earnings, thereby reducing the poverty trap. These two design features resemble an unconditional basic (...) income. I situate the experiments in the wider context of basic income and discuss their theoretical background and policy orientation. Under existing legal strictures, the experimental designs are too limited to judge the effects of replacing the conditional scheme of social assistance by an unconditional one. Yet these experiments point the way for future trials which can compare the effectiveness of basic income-oriented versus workfare-oriented treatments. (shrink)

In Anarchy, State, and Utopia, Robert Nozick contrasts entitlement theories of justice and “traditional” theories such as Rawls', utilitarianism or egalitarianism, and advocates the former against the latter. What exactly is an entitlement theory of justice? Nozick's book offers two distinct characterizations. On the one hand, he explicitly describes “the general outlines of the entitlement theory” as maintaining “that the holdings of a person are just if he is entitled to them by the principles of justice in acquisition and (...) transfer, or by the principle of rectification of injustice ”. On the other hand, his famous “Wilt Chamberlain” argument against alternative theories is first said to apply to “non-entitlement conceptions”, and later to any “end-state principle or distributional patterned principle of justice” — which amounts to an implicit characterization of an entitlement conception as a conception of justice which is neither end-state nor patterned. "Entitlement theories of justice: From Nozick to Roemer and beyond", Economics and philosophy 1/1 : 69-81.

This article challenges the general thesis that an unconditional basic income, set at the highest sustainable level, is required for maximizing the income-leisure opportunities of the least advantaged, when income varies according to the responsible factor of labor input. In a linear optimal taxation model (of a type suggested by Vandenbroucke 2001) in which opportunities depend only on individual productivity, adding the instrument of a uniform wage subsidy generates an array of undominated policies besides the basic income maximizing policy, including (...) a “zero basic income” policy which equalizes the post-tax wage rate. The choice among such undominated policies may be guided by distinct normative criteria which supplement the maximin objective in various ways. It is shown that most of these criteria will be compatible with, or actually select, the zero basic income policy and reject the basic income maximizing one. In view of the model's limited realism, the force of this main conclusion is discussed both in relation to Van Parijs' argument for basic income in Real Freedom for All (1995) and to some key empirical conditions in the real world. In 2003, Peratt demonstrated that rock art images worldwide bear a remarkable similarity to high-energy plasma discharge formations. In later papers, Peratt located the plasma discharge column in which all of these would have occurred at the Earth’s South Pole. This article accepts the relation between the rock art images and the plasma formations, but concludes that the geometry of the reconstruction is incompatible with the global occurrence of the rock art images. As a corollary, the finer details of the (...) reconstructed column must also be called into question. In particular, the reconstruction of the top cusp, the two upper plasmoids, and the filamentary sheath in a single column at the South Pole cannot be reliably deduced from the data as presented by Peratt. All evidence points to a worldwide distribution of the phenomena. (shrink)

One major way of arguing for the moral attractiveness of luck egalitarianism is indirect; it consists in showing that the view follows from competing views on distributive justice which one actually endorses. Kasper Lippert-Rasmussen (KLR) claims that luck egalitarianism is indirectly supported in this way by Rawls’s intuitive argument for the difference principle. That argument begins by asserting that the impact of social and natural contingencies on distributive shares is unjust. After clarifying the notion of indirect support, I argue against (...) KLR’s claim. Whether the argument goes on to support luck egalitarianism is a matter of interpretation which can only be decided by looking closer at what Rawls has to say about the difference principle than KLR’s own treatment of the argument allows. In its most plausible reading, the intuitive argument veers away from luck egalitarianism in favor of a non-egalitarian view of the difference principle as a principle of compensating advantage. On this view, inequality due to bad luck is not in any respect unjust when the least advantaged cannot be made better off under alternative arrangements. In conclusion I explain why there are good reasons of fairness to understand the difference principle in this way. (shrink)

Politiek gaat over het verenigen van gemeenschappelijke en conflicterende belangen in bindende collectieve besluitvorming op een wijze die door winnaars en verliezers kan worden aanvaard. In dit artikel baseer ik mij op het politiek gezaghebbende duurzaamheidsconcept van de Brundtlandcommissie in Our Common Future: ‘Duurzame ontwikkeling is ontwikkeling die tegemoetkomt aan de behoeften in het heden zonder de mogelijkheid van toekomstige generaties om te voorzien in hun eigen behoeften in de weg te staan’ . Dan blijkt direct dat het vinden van (...) principes voor een duurzame politiek lastig is, want het gaat hier om een morele eis rekening te houden met de belangen van mensen in komende generaties die nu nog geen deel uitmaken van een politieke gemeenschap. According to the logic of collective action, mere awareness of the causes of environmental degradation will not motivate rational agents to reduce pollution. Yet some government policies aim to enlist citizens in schemes of voluntary cooperation, drawing on an ethos of collective responsibility. Are such policies doomed to failure? This book provides a novel application of rational choice theory to a large-scale survey of environmental attitudes in The Netherlands. Its main findings are that rational citizens are motivated to cooperate towards (...) a less polluted environment to a large extent, but that their willingness to assume responsibility depends on the social context of the collective action problem they face. This empirical study is an important volume in the development of a more consistent foundation for rational choice theory in policy analysis, which seeks to clarify major theoretical issues concerning the role of moral commitment, self-interest and reciprocity in environmental behaviour. Welfare science has built its foundations on veterinary medicine and thus measures of health. Since bottlenose dolphins (Tursiops truncatus) tend to mask symptoms of poor health, management in captivity would benefit from advanced understanding on the links between health and behavioural parameters, and few studies exist on the topic. In this study, four representative behavioural and health measures were chosen: health status (as qualified by veterinarians), percentage of daily food eaten, occurrences of new rake marks (proxy measure of social activity), (...) and willingness to participate (WtP) in Positive Reinforcement Training sessions as qualitatively measured by their caretakers. These data were collected multiple times a day, every day over the course of a year from a multi-facility, large sample size (ndolphins= 51), allowing powerful analyses of the relationships between measures. First, it was found that dolphins with a higher WtP score also had a significantly better health status, ate a higher percentage of their daily food, and a lower occurrence of new rake marks. In addition, the WtP score was significantly lower up to 3 days before the weekly veterinary diagnosis of a decrease in health state; the percentage of daily food eaten and new rake mark measures did not show any significant change before such a diagnosis. These results suggest that WtP in training sessions is a potential behavioural measure of dolphin welfare, and an indicator of early changes in the dolphins’ health state. We therefore suggest measurement of WtP as a more practical and non-invasive tool to support veterinary care and general management. More work needs to be conducted to elucidate the influence of social behaviour on health, and to identify other potential welfare indicators, but this long-term study has shown that qualitative measures can be both practical and valid when assessing dolphin welfare. Anwendungen der Gendiagnostik und Reproduktionsmedizin erlauben es Wunscheltern, immer weiter auf das Erbgut ihrer Nachkommen Einfluss zu nehmen. Eine solche „liberale Eugenik“ wird mittlerweile auch in der Philosophie und Bioethik befürwortet. Wo liegen aber die Ursprünge eines solchen Denkens und wie ist eine umfassende Fortpflanzungsfreiheit zu bewerten? Ausgehend von einer freiheitlichen Ethik leistet die Studie eine immanente Kritik an der liberalen Eugenik und entwirft dabei eine eigene Position zum Umgang mit neuen gentechnischen Möglichkeiten.

This article seeks to address the problem of the ‘resource consumption bottleneck’ of creating legal semantic technologies manually. It describes a semantic role labeling based information extraction system to extract definitions and norms from legislation and represent them as structured norms in legal ontologies. The output is intended to help make laws more accessible, understandable, and searchable in a legal document management system.

Ethik-Komitees gehören zum festen Bestandteil des Ethikmanagements und der Organisationsethik in klinischen Einrichtungen des Gesundheitswesens. Entsprechende Ethikstrukturen und die damit verbundenen Angebote stoßen hinsichtlich ihrer Wirksamkeit allerdings an ihre Grenzen. Ihre Arbeitsweisen sind häufig reaktiv und eine Verankerung in den entsprechenden Organisationsebenen fehlt. Ausgehend von diesen Limitationen der klinischen Ethikberatung hat sich die multiprofessionelle „Arbeitsgruppe Ethik“ am Universitätsklinikum Tübingen um die Konzeption und Implementierung eines neuen Ansatzes zur nachhaltigen Integration von ethischen Reflexions- und Entscheidungsprozessen auf den Stationen des UKT bemüht. Mit dem Tübinger Modell der Ethikbeauftragten der Station verfolgt sie ein Pilotprojekt, das speziell geschulte Pflegekräfte aus allen Stationen des UKT als AnsprechpartnerInnen für ethische Fragen einsetzt. Damit stellen die Ethikbeauftragten eine Erweiterung zu etablierten Strukturen der Ethikberatung dar und ergänzen vorhandene Top-Down-Strategien. Der vorliegende Beitrag stellt die Zielsetzungen des Tübinger Modells dar und schildert erste Erfahrungen in der Umsetzung. Neben der Einbettung in organisationale Strukturen der Ethikberatung werden die stationsinternen und stationsübergreifenden Aufgaben der Ethikbeauftragten dargestellt. Zudem wird das Qualifikationsprogramm für Ethikbeauftragte sowie ein Train-the-Trainer-Konzept vorgestellt, welche eine vertiefende Entwicklung von pflege- und medizinethischer Kompetenzen unterstützen und Sicherheit in den stationsbezogenen Reflexions- und Entscheidungsprozessen vermitteln. A commonly used experimental procedure for the study of granulocyte kinetics involves the labelling and subsequent tracing of granulocyte DNA. Following the introduction of a label into the system, observations are made periodically on the concentration of label in the DNA of granulocytes taken from the circulating blood. A mathematical model for the expected value of this concentration has been derived, studied, and related to experimental observations from studies using P32 as a label. Insofar as the derivation of the model (...) accurately incorporates the relevant aspects of granulocyte kinetics, the model will be useful in the interpretation of the experimental observations in terms of these kinetics.Among other things, study of the model indicates that the assumption of “flash” labelling made with respect to some labels is quite crucial and needs to be examined critically. It has also been necessary to make adjustments to allow for the observed emergence of labelled cells from the marrow soon after label introduction. In addition, despite a high degree of confounding of parameter effects it has been possible to suggest bounds on some of the parameters of the model for some species. The bounds will be refined as the model is improved and more data become available. Study and development of the model continues with particular interest in generalizations to include the diseased state chronic granulocytic leukemia. (shrink)

In this essay some proposals for discussion are made which deal with the question whether and how an “Option for the Poor” can be realized in jurisprudence. Do legal scientists have a special social and political responsibility? How can be argued for that responsibility? First of all I shall draw the ethical and scientific-ethical framework, which is necessary to deal with these questions. Then I shall present the main points of such an approach to jurisprudence. Finally I shall demonstrate concrete (...) possibilities for realizing an “Option for the Poor” in jurisprudence. (shrink)
